About Hit by an E-Bike or Scooter in New York? A Guide to Your Rights and Recovery

E-bikes, stand up scooters, and mopeds now share every block in New York, and the injuries that come with them land differently than car crashes. Wrist and arm fractures from bracing, road rash, head injuries without a helmet, and soft tissue and joint damage are the pattern. Pedestrians often never see or hear the rider coming.

Responsibility depends on who was riding and why. A rider working a delivery route may put their employer or the delivery company in the picture. A rental or share operator may be responsible for a defective brake or a poorly maintained machine. A property owner or the city can be responsible when a road or sidewalk hazard caused the crash. Many individual riders carry no insurance at all, which makes identifying every possible source of coverage the most valuable early step.

After a micromobility crash, get medical attention the same day, photograph the scene, the vehicle, and any company branding on the rider's gear or bag, get witness contact information, and report the incident so there is an official record. New York generally allows three years to file a personal injury lawsuit, and claims involving a public entity can require notice within 90 days.
