For most people, being involved in an incident where they were hurt due to someone else’s negligence is their first time hiring a lawyer. Without a family member or friend to guide them, many hire a lawyer quickly and without much thought.

Let me first say that most attorneys I know are excellent lawyers who do a fantastic job for their clients. I’m proud to associate with them. However, as in any profession, not everyone meets the high standards that should be required.
If you have an active case, here are six red flags to watch for to ensure you haven’t hired a bad lawyer.
1. You Rarely Speak to Your Lawyer
All communication is routed through a paralegal or secretary.
Your calls are not returned in a reasonable time. (Keep in mind that lawyers are busy, so allow some time for a response.)
Your lawyer never initiates contact—you’re always the one reaching out.
A good lawyer should periodically update you on your case without waiting for you to ask.
2. You’re Not Being Heard
When you speak with your lawyer, they talk at you instead of listening to you.
Great lawyers understand that YOU are the key to your case. Your experiences make your case unique.
If your lawyer isn’t listening, they’re not developing your case fully to seek maximum value.
3. They Don’t Know Your Case
When you speak with someone from the firm, they mix up facts or don’t know the specifics of your case.
While occasional mistakes can happen (e.g., an outdated system or miscommunication), consistently not knowing your case is a major red flag.
4. They Push for a Quick Settlement
Your lawyer encourages you to settle very early in the process.
While there are situations where early settlement might be the best option (e.g., damages exceeding the insurance policy), this is rare.
Top value is usually achieved after proving that your case is thoroughly developed and poses a substantial risk to the insurance carrier—especially when you’re prepared to go to trial.
5. They Miss Deadlines or Delay Filing Your Lawsuit
Filing deadlines are missed, weakening your case.
Years pass, and your lawsuit is still not filed.
Occasional delays can happen, but if this is a pattern, it’s a sign your lawyer is reactive instead of proactive.
6. They Placate You Instead of Being Honest
Your lawyer tells you what you want to hear instead of the truth.
Great lawyers understand that while the truth may hurt, clients need honest information to make important life decisions. The best path forward starts with knowing the truth and developing a solid game plan.

Before hiring a lawyer:
Seek a referral from someone you trust.
Read online reviews (but take them in context, as motivations behind reviews can vary).
Research the firm or attorney.
If you already have a lawyer:
Have an honest, respectful conversation with the head attorney about your concerns.
If the situation doesn’t improve, consider finding a new attorney you trust.
